Welcome to QuantumFlex SmartForms. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using QuantumFlex SmartForms ("Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Service.

You must be at least 18 years old to use this Service. By using our Service, you represent that you are at least 18 years of age.

2. Description of Service

QuantumFlex SmartForms is a web-based form builder application that allows users to:

• Create digital forms with various field types
• Share forms via unique links
• Collect and manage form submissions
• Export forms as standalone HTML files
• Export submission data as CSV files

3. Account Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account.

4. Subscription Plans and Pricing

4.1 Free Plan

The Free Plan includes:

• Up to 3 forms
• 50 submissions per month
• Basic branding (colors only)
• QuantumFlex branding on exported forms

4.2 Pro Plan ($10/month)

The Pro Plan includes:

• Unlimited forms
• Unlimited submissions
• Full branding customization (logo, company name, custom footer)
• Remove QuantumFlex branding
• Priority support

4.3 Payment Terms

Pro subscriptions are billed monthly. Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

4.4 Refunds

We offer a 30-day money-back guarantee for Pro subscriptions. Contact support within 30 days of your initial payment for a full refund.

5. User Responsibilities

You agree NOT to:

• Use the Service for any illegal purpose
• Collect personally identifiable information without consent
• Create forms that violate any laws or regulations
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Upload malicious code or content
• Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Property

The Service, including all software, design, content, and documentation, is owned by QuantumFlex AI and protected by copyright and other intellectual property laws.

6.2 Your Content

You retain ownership of all forms and data you create using the Service. By using our Service, you grant us a limited license to store, process, and display your content solely to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You acknowledge that:

• You are responsible for the data collected through your forms
• You must comply with applicable data protection laws
• You must obtain proper consent when collecting personal data

8. Termination

8.1 By You

You may cancel your account at any time through your account settings. Upon cancellation:

• Your access to the Service will end
• Your data will be deleted within 30 days
• No refunds for partial billing periods (except within 30-day guarantee)

8.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUANTUMFLEX AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless QuantumFlex AI from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes shall be resolved in the courts of Alberta.

15. Severability
